We are committed to managing your personal information in accordance with the Privacy Act 1988 (Cth) (Privacy Act), the Australian Privacy Principles (APPs) and binding codes issued under the Privacy Act.

This Privacy Policy applies to services and products in connection with photographs offered by us (Photo Product) and with our web site, bridgeclimbphotos.com (Photo Site). 

This Photo Site is separate and distinct from the www.bridgeclimb.com website, which provides different services and products and, therefore, the www.bridgeclimb.com website has a different privacy policy that applies to use of that website and the Bridge Climb and Bridge Museum attractions, made available on that site (BridgeClimb Privacy Policy). 

Please ensure you have read and understood the Terms and Conditions, BridgeClimb Privacy Policy and this Privacy Policy, all of which should be read in conjunction with each other.

By using the Photo Product or this Photo Site, you consent to the collection and use of information in the manner described below.  This Privacy Policy explains the nature of the information we collect and how we use that information in order to continue providing outstanding services and products.

Kodak

Our Photo Products are provided to you through KODAK ALARIS. To receive your Photo Products, you must register for an account with KODAK ALARIS. You acknowledge and agree that KODAK ALARIS may have separate terms and privacy policies applying to your KODAK ALARIS account and any personal information provided to or otherwise collected by them.  

Types of information collected

The personal information collected and maintained by us in connection with the Photo Product will generally comprise your name, email address, shipping address, billing name and address, credit card number and expiration date, information you submit to process your order, customer service records and other information relevant to providing you with the services you are, or someone else you know, is seeking.  

We may also collect and hold sensitive information about you, particularly where we hold photos of you. This may include information about your health and any medical conditions, racial or ethnic origin.  We will only use, disclose or store photos of you with your consent or where otherwise permitted by law.

Method of collection

We collect your personal information through our photograph service that operates on our sites.

Where you wish to include others (Invitees), in your photographs,we will request you submit personal information, such as email addresses, of your Invitees. It is your responsibility to ensure that the Invitees have consented to the use of their personal information and are aware of this privacy policy.

Furthermore, any contact with our Customer Service team or other communication from you, such as telephone calls or email correspondence, may be recorded to help us provide better service.

If we receive unsolicited information about you that we do not ask for or which is not directly related to our functions or activities, we may be required to destroy or de-identify that information, provided it is lawful and reasonable to do so.

Photos, videos and surveillance videos

We will collect your personal information including taking photos and videos of you and conducting video surveillance to facilitate our Photo Service. Appropriate signage alerts you to these practices on our site, and you consent to that collection by remaining on those sites and utilising the services. We will delete all irrelevant recordings once you have been matched with your photos and videos for the purpose of the Photo Service. We will take steps to destroy our records of your photos and videos after 30 days from the day you complete the Bridge Climb.

Failure to provide information

We require your personal information to enable us to provide the Photo Service, such as for you to view, order or share photos as part of the Photo Service.  You can refrain from supplying personal information, but you then will be unable to take full advantage of the Photo Service and this Photo Site and the services and products offered therein.

Purpose of collection

The personal information that we collect and hold about you, depends on your interaction with us.  Generally, we will collect, use and hold your personal information if it is reasonably necessary for or directly related to the performance of our functions and activities and for the purposes of:

1. providing our goods and services to you or someone you know;
2. conducting and facilitating our internal business operations including the fulfilment of any legal requirements;
3. communicating with you about our products or services;
4. informing you about products or services which we think may be of interest to you;
5. if you have consented to marketing or otherwise permitted by law, providing you with information about other services that we and other organisations that we have affiliations with, offer that may be of interest to you;
6. if you have consented to marketing or otherwise permitted by law, providing you with information relevant to your type of business or other area of expertise or interest;
7. analysing our services and customer needs with a view of improving, supporting and enhancing our services; or
8. contacting you to provide testimonial for us.

Except as otherwise permitted by law, we only collect sensitive information about you if you consent to the collection of the information and if the information is reasonably necessary for the performance of our functions, as set out above.

Laws under which personal information is collected and used

In Australia, we collect personal information to assist us to fulfil our legal and regulatory obligations, including corporate record keeping obligations under the Corporations Act 2001 (Cth), the Competition and Consumer Act 2010 (Cth) and the A New Tax System (Goods and Services Tax) Act 1999 (Cth).

Marketing and Promotion

When you have ‘opted-in’ or ‘subscribed’ to our mailing list, we may use your personal information to deliver news from us and updates to you by email.  You can opt out of our promotional emailing list by following instructions included in an email we send you, or by selecting an opt out option available through a corresponding hyperlink on this Photo Site.

We (and our related entities and third party service providers) will not use or reproduce any photograph taken of you without obtaining your prior consent. Your images will not be used for any purpose, including display and purchase, without your express consent. We will always seek your consent if your image is intended to be used in marketing or communication materials.

Generally speaking, we use cookies to improve services provided to users of this Photo Site. For example, when you visit this Photo Site, we may assign you a unique user ID and store it on your computer in the form of a cookie (unless your browser’s cookie support has been disabled). The main purpose of cookies is to optimise the performance and functionality, to customise web pages for you and present you with content and offers specific to your interests.

 IP Address

If you access our website, we may collect additional personal information about you in the form of your IP addresses. This is predominantly to assist with system administration purposes and to gather broad demographic information. This information is gathered in aggregate only and cannot be traced to an individual user.

This Photo Site may contain links to other websites. We are not responsible for their privacy practices, policies, or content.

Use and Sharing Personal Data

Generally, we only may disclose your personal information to others for the purposes specified in the section above. We may disclose personal information about you to:

1. our related entities to facilitate our and their internal business processes;
2. third party service providers (such as credit card authorisation companies, merchandise distributors, website analysis companies, shippers and KODAK ALARIS), who assist us in supplying our services or who perform functions on our behalf, such as support services, technology hosting and cloud service providers. These service providers may not be required to comply with our privacy policy;
3. where required to or authorised to do so by law; and
4. if you have consented to marketing or otherwise permitted by law, other organisations with whom we have affiliations so that those organisations may provide you with information about services.

Security

We take appropriate security measures to protect against unauthorised access to your personal information, including against sharing your photos without your consent. 

We use reasonable measures to safeguard personal information, including via passwords, electronic firewalls, and encryption.

We endeavour to provide a secure website, but cannot guarantee the confidentiality of electronic communication.  Transmissions to and from this Photo Site are not encrypted, nor are email messages. Accordingly, you should carefully consider whether to submit sensitive information that you would not want made public, and should recognize that your use of this Photo Site is solely at your own risk.

You may establish a password-protected personal online account for storing, organizing and sharing digital images, as well as for using our other services.  In order to establish your personal account, you may be requested to submit additional personal information, including your name, user ID, email address, password, and other information contained in a Photo Claim ID provided to you during your visit to us.

Accessing Your Information

You may access the personal information we hold about you, upon making a written request to privacy@bridgeclimb.com.  We will respond to your request within a reasonable period. We may charge you a reasonable fee for processing your request (but not for making the request for access).

We may decline a request for access to personal information in circumstances prescribed by the Privacy Act, and if we do, we will give you a written notice that sets out the reasons for the refusal (unless it would be unreasonable to provide those reasons), including details of the mechanisms available to you to make a complaint.

If, upon receiving access to your personal information or at any other time, you believe the personal information we hold about you is inaccurate, incomplete or out of date, please notify us immediately. We will take reasonable steps to correct the information so that it is accurate, complete and up to date.

If we refuse to correct your personal information, we will give you a written notice that sets out our reasons for our refusal (unless it would be unreasonable to provide those reasons), including details of the mechanisms available to you to make a complaint.

Complaints and Feedback

If you wish to make a complaint about a breach of the Privacy Act, the APPs or a privacy code that applies to us, please contact us using the details below and we will take reasonable steps to investigate the complaint and respond to you. If after this process you are not satisfied with our response, you can submit a complaint to the Office of the Information Commissioner.
