The Olympic Regional Development Authority of the State of New York (herein referred to as ORDA) recognizes and respects the importance of your privacy. This Privacy Policy applies to services and products in connection with photographs offered at ORDA venues and with the ORDA Photo web sites, moregorephotos.com; whitefacephotos.com;  miraclemomentphotos.com and canamphotos.com (these “Photo Sites”). This Privacy Policy may also apply to digital photography services provided to you by Kodak Alaris Inc. (“KODAK ALARIS”), relating to the Photo Product and services in connection with this Photo Site. The Photo Sites are separate and distinct from the unique ORDA venue websites, which provides different services and products and, therefore, the http://www.goremountain.com; http://www.whitefacelakeplacid.com;  http://www.orda.org and http://www.canamhockey.com websites have different privacy policies and different Terms of Use, as posted thereon.

If you have not already done so, please click on the “Terms” link at the bottom of this page to review the Terms and Conditions (the “Terms”) that govern your use of the Photo Product, this Photo Site and the services offered on this Photo Site. This Privacy Policy is considered part of the Terms.

By using the Photo Product or these Photo Sites, you consent to the collection and use of information in the manner described below. This Privacy Policy explains the nature of the information we collect and how we use that information in order to continue providing outstanding services and products.

Collecting Personal Information

Personal information, such as your name, telephone number and e-mail address, is requested when you choose to use the Photo Product or any of our services on this Photo Site. The personal information is collected in connection with the service(s) or products that you order and/or use, for example for reviewing digital images (“photos”), customizing photos, sharing photos, ordering prints and photo products, or for sending contacting KODAK ALARIS for additional services. Furthermore, KODAK ALARIS may receive and store your personal information in connection with the Photo Product or this Photo Site.

KODAK ALARIS and ORDA each take appropriate security measures to protect against unauthorized access to your personal information, including against sharing your photos without your consent. This Photo Site does not intentionally or knowingly collect personal information or data from children under the age of 13. You must be at least 18 years of age in order to register as a member of this Photo Site and to purchase the services and products offered in connection with this Photo Site and/or the Photo Product.

When you sign up to obtain your photographs as a result of a visit to an ORDA photo website, you may establish a password-protected personal on-line account for storing, organizing and sharing digital images, as well as for using our other services. In order to establish your personal account, you may be requested to submit additional personal information, including your name, user ID, e-mail address, password, and other information contained in a Photo Claim ID provided to you during your visit.

When you order prints, products or other paid products or services, you may be requested to you submit additional personal information, such as the shipping address, billing name and address, as well as the credit-card number and expiration date. Please see the Terms for other terms and conditions relating to such purchases, including, without limitation, credit-card authorization, refund policy, pricing, and sales tax.

In connection with services offered on this Photo Site, we may use personal information you submit to process your order and to reply to your e-mail. If you do not opt-out of our promotional e-mailing list, we may also use your personal information to deliver ORDA news and updates to you by e-mail. We require your personal information to enable us to provide services, such as for you to view, order or share photos. You can refrain from supplying personal information, but you then will be unable to take full advantage of this Photo Site and the services and products offered therein.

In case you want to share your photographs with others (“Invitees”), we will request you to submit personal information, such as e-mail addresses, of your Invitees.

Furthermore, any contact with our Customer Service team or other communication from you, such as telephone calls or e-mail correspondence, may be recorded to help us provide better service.

If you contact us by e-mail, then we naturally will have your e-mail address and name and any other information in your message. We will use this personal information only to reply to your message. We will not share your e-mail address with third parties, except as provided herein.

Non-Personal Data

In addition to personal information, we may also collect non-personally identifying information (“non-personal information”) about visitors to this Photo Site. This non-personal information may include an identification of a website that the visitor arrived from and departs to, as well as the IP address of the particular computer being used to access this Photo Site. While it may be possible to correlate this information with particular individuals, we do not do so. We use this information in the aggregate, for example, to show overall patterns for all visitors.

Information We Automatically Collect Cookies

There are limited circumstances in which we share personal data with reputable third parties as set forth below. Our primary goal in collecting your personal information is to provide you with a personalized, relevant, and user-friendly experience on this Photo Site and in connection with our services and products.

Third Parties

We may share your personal information with reputable third-party providers for the sole purpose of providing you with the products, services and information you have requested. We may also choose to offer certain reputable third party products through this Photo Site and may disclose certain portions of your personal and non-personal information to allow those reputable third-party producers to fulfill your product and/or service order. Examples of such third-party providers are credit-card authorization companies, merchandise distributors and shippers, as well as KODAK ALARIS, which provide various services in connection with this Photo Site and may take many of the actions described herein. Among the many services KODAK ALARIS provides in connection with this Photo Site, KODAK ALARIS handles all orders, including credit-card authorizations. From time to time, we may also engage the services of reputable third parties to help us analyze use of this Photo Site. These third parties will be contractually bound to use the personal data only according to this Privacy Policy, and will not be authorized to send you any information about goods and services from other companies without your express permission.

Promotional Materials

When you choose to use the Photo Product or any of our services related to this Photo Site, you expressly agree to “opt-in” to our promotional e-mailing list. Our promotional e-mailing list entitles you to receive information of site improvements, feature announcements, newsletters, ORDA promotional offers, and occasional third-party promotional offers that may be of interest to you. Additionally, you may receive promotional offers from one or more third parties when you expressly opt-in to receive such offers, for example, by selecting a respective checkbox or other graphical screen control in this Photo Site.

We provide you an opportunity to “opt-out” of our promotional e-mailing list, in which event we will not send you separate e-mail messages announcing events featured in the newsletter. You can opt out of our promotional e-mailing list by following instructions included in an email we send you, or by selecting an opt out option available through a corresponding hyperlink on this Photo Site.

Other Uses

We use your personal information to make your ORDA experience enjoyable. For example, we may send you offers and other applicable information about ORDA and/or our third party marketing partners via telephone or email.

Note that one reason we are able to offer you relevant promotions is that we reserve the right to use aggregated, anonymous, non-personal information about our users as a group. We use such information for statistical analysis of user behavior, product development, content improvement and marketing, promotional and advertising purposes. We may also make that aggregate non-personal information available to select third party partners.

We may transfer personal or non-personal information to an affiliate or third party as part of a transfer of business assets. The exchange information would continue to be covered by the promises in this Privacy Policy.

We may release personal or non-personal information in order to comply with the law, enforce terms of use and other agreements, and protect customers and others.

Who Sees Your Information?

ORDA employees or employees of a third party marketing partner companies or service providers that provide services to ORDA in connection with the Photo Product, this Photo Site or other marketing activities as directed by ORDA may see your personal and non-personal information. In addition, your personal and non-personal information may be seen by employees of ORDA and such third parties, including, without limitation, KODAK ALARIS, in order to evaluate, validate, or correct problems with your account.

Security

We use reasonable measures to safeguard personal information, including via passwords, electronic firewalls, and encryption. Neither ORDA or KODAK ALARIS store credit card data on the web-server.

ORDA endeavors to provide a secure website, but cannot guarantee the confidentiality of electronic communication. Transmissions to and from this Photo Site are not encrypted, nor are e-mail messages. Accordingly, you should carefully consider whether to submit sensitive information that you would not want made public, and should recognize that your use of this Photo Site is solely at your own risk.
